The Winning Arbor Snowboard Design: Hummingbird
After a careful review of the finalists, Arbor and REI have named Hummingbird the winner of the Arbor snowboard design contest! The design, by KCimaging00, was selected from the top 5 contest favorites as voted by visitors to REI.com.
The Arbor Hummingbird will be available for sale exclusively at REI as part of the women's snowboard line starting in September 2010.
Congratulations to KCimaging00 for his winning design! Besides bragging rights, he wins a free Hummingbird board and a $1,000 REI gift card.
When he's not whipping up the Photoshop wizardry, freelance graphic designer Kyle Caldabaugh can often be found behind the lens of a camera. A graduate of Savannah College of Art and Design, he calls his art a "grungy, graffiti-based, industrialized urban expression." Kyle makes his home in Jacksonville, Florida.

Eligibility: The REI/Arbor Art Contest (the "Contest") is open only to legal residents of the fifty (50) United States, (including D.C.), who are at least thirteen (13) years old (except where prohibited) at the time of entry and who did not purchase any products, services or equipment for the purposes of entering this Contest. Employees, officers and directors of Recreational Equipment, Inc. ("REI") and Arbor Snowboards, Inc. and any of their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer and/or director are not eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where taxed, restricted or prohibited. People less than eighteen years of age will need their parent or legal guardian's permission to enter. By granting permission your parent or legal guardian agrees that you will comply with Official Rules and will fully indemnify and hold harmless Sponsor in the event of your failure to comply with Section 5 below.

Agreement to Official Rules: Participation in this Contest constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's and Administrator's decisions, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Timing: The Contest begins on November 2, 2009 at 12:00 a.m. Eastern Time ("ET"), ends on December 31, 2009 at 11:59 p.m. ET (the "Contest Period") and consists of two (2) phases as set forth in the chart below.

Sponsor's computer is the official time-keeping device for the Contest.
How to Enter: During the Submission Phase, visit www.rei.com/arbor-contest and follow the instructions to submit pieces of art or graphics (the "Submission"). By uploading your Submission, you agree that your Submission conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the "Guidelines and Restrictions") and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions. By uploading your submission, in addition to rights granted below, you: a) grant to Sponsor all rights necessary to display your submission on Sponsor's Web site; b) hereby waive any so-called moral (e.g., creative rights) in your submission; and c) represent and warrant that your submission does not contain material that violates or infringes upon any person's or entity's rights including, but not limited to, the rights of privacy (including, but not limited to, publicity and/or right not to be held in a false light), publicity or any intellectual property rights (including, but not limited to, copyright infringement).
- The Submission may be a digital photo or digital artwork but must be 150 dpi. Acceptable file formats are: psd, tiff, pdf, or eps and files must not exceed 2 mega bytes when submitted;
- Submitted images must not exceed 8 inches in length or width;
- All participants are encouraged to keep in mind that the winning submission will be used on a snowboard and therefore knowing it will be used in a vertical format;
- It is also important to note that the final snowboard will have Arbor's traditional sustainably-sourced-wood-topsheet, the type of wood used will be selected to match the style of the winning art;
- Participants are encouraged to develop negative space in or around their art that allows the wood to add to the final look and feel of the snowboard design;
- The Submission must be entrant's original creation and owned one hundred percent (100%) by the entrant; and
- The Submission cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.
Finalists Submission Guidelines:
- Five finalists will be asked to resubmit their art in a larger and higher resolution format.
- These images must exceed 20 inches in length or width and have a resolution of 300 dpi. Acceptable file formats are: psd, tiff, pdf, or eps.
- The Submission must not contain material that violates or infringes upon any person's or entity's rights including, but not limited to, the rights of privacy (including, but not limited to, publicity and/or right not to be held in a false light), publicity or any intellectual property rights (including, but not limited to, copyright infringement);
- The Submission must not disparage any person or entity;
- The Submission must not contain brand names or trademarks other than Sponsor's mark, which entrant has a limited license to use for the sole purpose of creating and uploading a Submission in this Contest;
- The Submission must not contain footage, images or artwork not created by entrant;
- The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, and/or defamatory;
- The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
- The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where Submission is created.
For All Submissions: Entrant must have signed permission from all individuals (parents/legal guardian of children, if featured and if not your own) that appear in the Submission to use their name in the Submission and to grant the rights set forth herein. If requested by Sponsor, entrant must be able to provide such permissions in a form acceptable to Sponsor. In the event there is a conflict between the Terms and Conditions and these Official Rules with regard to this Contest, these Official Rules shall prevail. By uploading your submission, you hereby grant Sponsor the exclusive irrevocable sub-licensable right to use your artwork in perpetuity in the manufacturing and sale of snowboards without any further compensation to you. Further, by uploading a Submission, entrant grants to Sponsor (and Sponsor's licensees and assigns) a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, and otherwise exploit the Submission in all media now known or hereafter devised, throughout the universe, in any way Sponsor sees fit including, but not limited to, entertainment, instruction/education, promotional, advertising and/or marketing purposes; in connection with all rights granted herein, Sponsor (and Sponsor's licensees and assigns) shall also have the irrevocable right to incorporate Submissions, in whole or in part, into other works, in any form, media or technology now known or hereafter developed. If necessary, entrant will sign any necessary documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission, and may be required to send all raw artwork to Sponsor via a Sponsor specified method, at no cost to entrant. Released Parties (as defined in Section 9, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions; all of which will be void. Proof of submission will not be deemed proof of receipt by Sponsor.
Winner Determination: During the Judging Phase, REI Community members (individuals who have created a community profile on REI.com) will vote on the entries submitted. The five submissions with the most votes will move on to the final judging round. During the final judging round, a panel of qualified judges determined by Sponsor in its sole discretion will select the winning design from among the top five (5) Submissions determined by the Community members voting results. Final selection by Sponsor will be based on the following criteria ("Judging Criteria"):
- Artistic translation of the artwork into snowboard graphics; and
From the initial five (5) potential winners, the panel will then choose the winner from among all eligible Submissions.
Winner Requirements: Potential winners will be notified via email or phone on or about January 15, 2010. The potential Grand Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to execute and return to Administrator, within ten (10) days of the date notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release ("Affidavit") in order to claim his/her prize. If a potential winner cannot be contacted within a reasonable time period, fails to execute and return the Affidavit within the required time period (if applicable), is not in compliance with these Official Rules, or prize or prize notification is returned as undeliverable or rejected, such potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, at Sponsor's sole discretion. Only four (4) alternate winners will be selected through this process, after which the applicable prize will remain un-awarded. Acceptance of any prize shall constitute and signify winner's agreement and consent that Sponsor and its designees may use the winner's name, city, state, likeness, quotes, photo, Submission and/or prize information in any manner the Sponsor deems fit including, but not limited to, in connection with the exploitation of the Submission and for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law. Without limiting the generality of these Official Rules, winner shall irrevocably grant, transfer, convey and assign to Sponsor the entirety of the rights in and to the Submission and all renewals and extensions of copyright, and the right to secure copyright registrations thereto in perpetuity including, without limitation, the rights to use the Submission for any and all purposes in any and all media, whether now known, or hereafter developed, throughout the universe, in perpetuity. Winner accepts and acknowledges that Sponsor shall not be obligated to use the Submission, and that Sponsor in its sole discretion shall have the right to refrain from using the Submission. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder. Winner will indemnify Sponsor, Released Parties (as defined in Section 9, below) and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms. Grand Prize Fulfillment: The Grand Prize REI Giftcard will be fulfilled approximately four (4) to six (6) weeks after the end of Contest. The Grand Prize Arbor snowboard will be fulfilled in September 2010 when the snowboard has been completed and shipped from manufacturer, Arbor Snowboards.
Prizes: ONE (1) GRAND PRIZE: An REI Giftcard in the amount of $1,000 and an Arbor Element snowboard utilizing the winning artwork. ARV: $1,495.
FOUR (4) RUNNER UP PRIZES: A $500 REI gift card. ARV: $500.
For All Prizes: Prizes are non-transferable and no substitution or cash redemption will be permitted unless Sponsor, in its sole discretion, determines otherwise.
Winners are responsible for all federal, state and local taxes and any other costs, expenses or fees associated with prize acceptance and/or use not specified herein as being provided. Limit: One (1) prize per person. All prize details are at Sponsor's sole discretion.
Release: By participating, entrant (and their parent or legal guardian if entrant is a minor), agrees to release and hold harmless the Sponsor/Administrator and Arbor Snowboards, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, receipt or use or misuse of any prize and for any claim or cause of action based on publicity rights, defamation or invasion of privacy and/or merchandise delivery.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If terminated Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys' fees) from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest, or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any Submission.
Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by any state or federal court location in Seattle, Washington; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington. Entrant agrees that in the event of a dispute arising out of the use of Submissions, entrant's sole remedy shall be to seek money damages and entrant waves any right to seek to enjoin use of Submissions or other rights granted by entrant.
